EB-3 Employment-Based Third Preference Visa
The EB-3 visa is an employment-based immigrant visa designed for skilled workers, professionals, and unskilled (other) workers seeking permanent residency in the United States. This visa category allows foreign workers to obtain a green card through employer sponsorship.
Who Qualifies for an EB-3 Visa?
The EB-3 category is divided into three subcategories:
EB-3A (Skilled Worker Visa)
- Available to workers who are able to demonstrate that they have at least 2 years of job experience, education, or training that meets the job requirements specified on the labor certification.
- USCIS may consider relevant post-secondary education as training.
- You MUST be performing work for which qualified U.S. workers are not available in the U.S.
- Labor certification and a permanent, full-time job are required.
EB-3B (Professionals Visa)
- Available to individuals who are able to demonstrate that they possess a U.S. baccalaureate or foreign equivalent degree, and that a baccalaureate degree is the normal requirement for entry into the occupation.
- You MUST be performing work for which qualified workers are not available in the United States.
- However, in this category, education and experience may not be substituted for a baccalaureate degree.
- Labor certification and a permanent, full-time job offer required.
EB-3C (Unskilled or Other Workers Visa)
- Available to individuals who are able to demonstrate the ability to perform unskilled labor (requiring less than 2 years training or experience), that is not of temporary or seasonal nature.
- You MUST be performing work for which qualified workers are not available in the United States.
- Labor certification and a permanent, full-time job offer required.
EB-3 Visa Process
- PERM Labor Certification – The employer must prove no qualified U.S. workers are available.
- Form I-140 (Immigrant Petition) – The employer files a petition with USCIS.
- Adjustment of Status or Consular Processing – The applicant applies for a green card.
